Terms of Service

1. Acceptance of Terms

By creating an account or using Sangoly ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility — 18+ Only

You must be at least 18 years old to use Sangoly. By using the App, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate any account suspected of being held by a minor without notice.

If you become aware that someone under 18 is using Sangoly, please report the account immediately via the in-app reporting feature.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. Each user may maintain only one account.

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access.

4. User Content and Conduct

You retain ownership of any content you create on Sangoly (including audio, video, profile information, and chat messages). By using the App, you grant Sangoly a non-exclusive, worldwide, royalty-free license to display, transmit, and distribute your content solely for the purpose of operating the service.

You will NOT use Sangoly to:

• Post or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially or ethnically objectionable
• Engage in hate speech, harassment, or targeted attacks against any individual or group
• Share sexually explicit content or engage in sexual conduct on livestreams or in audio rooms
• Promote violence, terrorism, illegal drugs, or self-harm
• Impersonate any person or entity
• Distribute spam, scams, malware, or fraudulent content
• Violate the intellectual property rights of others
• Attempt to access or use other users' accounts without authorization

Sangoly reserves the right to remove content and terminate accounts that violate these terms, at our sole discretion, without notice.

5. Live Audio Rooms and Livestreams

Sangoly uses the Agora.io platform to provide real-time audio and video communication. By joining a room or livestream, you understand that your voice (in audio rooms) or your video and voice (in livestreams) are transmitted in real-time to other participants.

IMPORTANT: Live audio rooms and livestreams are NOT recorded or stored by Sangoly. When a session ends, no audio or video record is retained on Sangoly's servers. However, Sangoly cannot prevent other users from independently recording sessions using third-party tools, and we are not responsible for such recordings.

Live sessions have a maximum duration of 3 hours. Sangoly may terminate sessions that exceed this limit or violate these Terms.

6. Subscription and Payments

Sangoly offers an auto-renewing monthly subscription ("Sangoly Premium") that unlocks unlimited viewing of audio rooms and livestreams. Free users can preview each session for one minute.

Subscription details:

• Price: $1.99 USD per month (or local equivalent set by Apple)
• Billing: Charged to your Apple ID at confirmation of purchase
• Auto-renewal: Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• Cancellation: You may cancel your subscription at any time through your iOS Settings → Apple ID → Subscriptions
• Apple retains 15% of subscription revenue as their App Store fee (under Small Business Program)

7. No Refund Policy

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE EXCEPT WHERE REQUIRED BY APPLICABLE LAW. By subscribing to Sangoly Premium, you expressly acknowledge that:

• Subscription fees are not refundable, in whole or in part
• Cancellation does not entitle you to a partial refund for unused time in the current billing period
• You will retain access to Premium features until the end of your current billing period after cancellation
• Refund requests must be directed to Apple, not to Sangoly. Apple's refund policy applies. Visit reportaproblem.apple.com to request a refund from Apple.

8. Creator Earnings and Payouts

Creators on Sangoly may earn revenue from a creator pool funded by user subscriptions:

• Earnings are credited daily based on viewer watch minutes
• Payouts are processed monthly between the 1st and 2nd of each month via PayPal
• Minimum payout threshold: $10 USD. Balances below this threshold roll over to the next month
• Creators must register a valid PayPal email in their account settings to receive payments
• Sangoly retains 50% of net revenue (after Apple's fee) as platform fees. The remaining 50% is distributed to creators based on their share of total watch minutes
• Sangoly is not responsible for failed PayPal transfers due to incorrect, unverified, or unregistered PayPal accounts
• Earnings forfeit after 12 months of account inactivity

9. Termination

Sangoly may suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any reason at our sole discretion. Upon termination, your right to use the App ceases immediately.

Termination does not entitle you to a refund of any subscription fees paid.

10. Disclaimer of Warranties

SANGOLY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SANGOLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

12. Changes to Terms

We may update these Terms at any time. Continued use of Sangoly after changes constitutes acceptance of the new Terms. Material changes will be notified in-app.

13. Governing Law

These Terms are governed by the laws of the Democratic Republic of the Congo, without regard to conflict of law principles.
